38 Gramercy Park: About Monday’s Overnight Work
August 2026 · We heard you, and we raised it
Dear Neighbors,
On Monday night, many of you were kept awake — and so was I. The concrete operation at 38 Gramercy Park ran far later than anyone expected, with cement deliveries continuing past 10:30 PM and work stretching into the night. By Tuesday morning, we had heard from neighbors in several buildings around the Park, and we want you to know exactly what we did and what we learned.
We Raised It the Same Day
On Tuesday morning, the Block Association took your complaints directly to the project’s senior management at Legion Investment Group and asked for an explanation and a response to the community.
What the Project Team Told Us
The project team acknowledged that Monday night’s concrete operation ran much later than anyone anticipated, and recognized the disruption it caused to surrounding neighbors. Their explanation, in brief: once a structural concrete pour reaches a certain stage, stopping mid-placement can compromise the structural integrity, quality, and safety of the work, so the team must weigh interrupting the operation against completing it as designed. In this case, they completed the pour.
The team also told us they are reviewing the sequence of events with their construction managers to identify how to reduce the likelihood of this happening again, and they reaffirmed their commitment to communicating openly and minimizing disruption as construction progresses.
A Word About Construction Hours
Several neighbors have asked how late-night work can be legal at all. Under City rules, standard construction hours are 7 AM to 6 PM on weekdays. Work outside those hours — including evenings and weekends — requires an After Hours Variance issued by the Department of Buildings, and active permits and variances for any site are publicly searchable on the DOB’s website. We have asked the project team to confirm the permit coverage for any after-hours operations, and we will share what we learn.
